OFFENSE:                     Penal Code 191.5 (a) – Gross Vehicular Manslaughter While Intoxicated

SUMMARY: 

On Monday, July 21, 2014, at approximately 9:24 p.m., Barstow Police Department Officers responded to a report of an injury traffic collision involving a pedestrian and a pick-up truck in the 2600 block of W. Main Street. Barstow Police Officers and emergency medical personnel from the Barstow Fire Department were on scene within minutes. The investigation revealed Fish was traveling westbound in the #2 lane of traffic when he struck the 17 year old male who had been walking westbound in the #2 lane of traffic.

Fish indicated he did not see the pedestrian until just prior to colliding with him. There were no skid marks located at the scene of the collision. Fish stopped his vehicle after the collision and waited for the arrival of police and fire personnel.

The pedestrian, who was propelled several feet west of the original collision due to the force of the impact, was pronounced dead at the scene of the collision by medical personnel. Due to information gathered during the investigation, it is believed the pedestrian was walking home from a friend’s house when he was struck by the vehicle; however, it is unknown why he would be walking in the traffic lane. The pedestrian was identified by family, who showed up at the scene of the collision after being notified by a friend.

Further investigation revealed that Fish may have been under the influence of alcohol and a controlled substance at the time of this collision. A preliminary test conducted at the Barstow Police Department indicated fish had a controlled substance in his system. Further testing is being conducted to determine the alcohol content and specific controlled substance that may be involved.

Fish was booked at the San Bernardino County Sheriff’s Jail in Barstow for being in violation of California Penal Code section 191.5(a) – Gross Vehicular Manslaughter While Intoxicated.
