On September 20, 2016 at approximately 11:50 PM, Officer McDowell attempted to stop a subject riding a bicycle on the wrong side of the roadway, in the 300 block of Melissa Avenue, which is a violation of California Vehicle Code section 21650.1. The subject, who was later identified as David Dwayne Preston, attempted to evade Officer McDowell by refusing to stop while continuing to ride his bicycle northbound through alleyways and parking lots.
Officer McDowell followed Preston into the Cactus Motel located in the 900 Block of East Main Street where Preston attempted to hide between two vehicles. As Officer McDowell followed Preston he observed Preston wearing a backpack. Officer McDowell contacted Preston where he was hiding and saw that he had discarded the backpack he was wearing. Officers found the backpack and conducted a search of its contents. Officers located a loaded .22 caliber revolver inside.
Preston was arrested and transported to the Barstow Police Department for further investigation. A check of Preston’s criminal history revealed that he had a prior felony conviction and was prohibited from possessing any firearms.
Preston was booked at the High Desert Detention Center for PC 29800(a)(1)- Felon in Possession of a Firearm, PC 25850(a)(2)-Carrying a Loaded Firearm in Public, and PC 25400-Carrying Concealed Firearm on a person.
