On May 15, 2017, at approximately 4:24 P.M., dispatch received a call for service at Walmart regarding a theft that was occurring. The caller, a loss prevention agent, reported two male adults had entered the store together and one of them stole several items from the store. The male who stole, fled out of the store and was entering a white colored sedan in the store parking lot.
Officer Escalante arrived at the location and saw a white sedan traveling west on Sunrise Street towards Higgins Road at a high rate of speed. Officer Escalante attempted to catch up to the vehicle but to no avail. Additional officers checked the area thoroughly for the vehicle but were unsuccessful in locating it.
Officer Escalante returned to the store and contacted the agent. The agent pointed out the second male identified as Adam Pinkus. Officers contacted Pinkus and talked to him about the theft however, he denied any involvement. Pinkus told officers that he drove his father’s white Lexus to the store with his friend Marcellus Nash who just left the store to sit in the vehicle and wait for him.
While speaking with Pinkus, a call for service was received by dispatch regarding a traffic collision that just occurred in the 300 Block of Higgins Road. The caller advised that a white 4-door Lexus collided into a wall and then fled from the area.
Pinkus and Officer Escalante went to the parking lot to check on his vehicle and saw that it was missing. Pinkus stated that he did not give anyone permission to drive his vehicle. Pinkus then contacted his father the register owner of the vehicle and advised him what occurred.
The registered owner arrived and told officers that Nash took his vehicle without permission and he wanted to report the car stolen.
Officers obtained Nash’s home address and went to the residence. The vehicle was located in front of the residence with damage from the collision. Officers contacted Nash inside the residence and placed him under arrest for stealing the vehicle. Nash was transported to the Barstow Police Department and questioned further about the incident.
Nash was subsequently booked at the San Bernardino County Jail in Barstow for Penal Code 487(d) (1) - Possession of Stolen Vehicle and California Vehicle Code 10851- Vehicle Theft.
