PRESENTATIONS

1.                   CERTIFICATE OF APPRECIATION FOR LENWOOD ELEMENTARY SCHOOL STUDENT

Recommended Action: Presentation Only.

2.                   PROCLAMATION AFFIRMING THE CITY OF BARSTOW'S SUPPORT OF AND PARTNERSHIP WITH THE 2010 CENSUS

Recommended Action: Present proclamation affirming the City of Barstow's commitment to the 2010 Census and to ensure that every resident is counted.

3.                   RECOGNITION OF DON BRADEN, TEACHER AT BARSTOW HIGH SCHOOL

Recommended Action: Present proclamation to Don Braden, recognizing him for his 45 years of service to Barstow Unified School District, our youth and our community.

4.                   RECOGNITION OF VETERANS WHO PARTICIPATED IN THE 23RD NATIONAL VETERANS GOLDEN AGE GAMES

Recommended Action: Present certificate to the five residents of the Veterans Home of California - Barstow for their participation in the 23rd National Veterans Golden Age Games.

PUBLIC HEARINGS

5.                   PUBLIC HEARING - INTRODUCTION AND FIRST READING - PROPOSED COMPREHENSIVE AMENDMENT TO SECOND UNIT REGULATIONS CONTAINED IN THE BARSTOW MUNICIPAL CODE (REF.: PORA-09-0001)

Recommended Action: That, after conducting a Public Hearing, the City Council concur with the Planning Commission's recommendation to comprehensively amend the City's Second Unit Ordinance regulations, Introduce Ordinance No. 849-2009 for PORA-09-0001, by title only and waive the full reading.

PUBLIC COMMENTS: THIS IS THE TIME AND PLACE FOR THE GENERAL PUBLIC TO ADDRESS THE CITY COUNCIL ON MATTERS WITHIN THEIR JURISDICTION THAT ARE NOT CURRENTLY ON THE AGENDA.  STATE LAW PROHIBITS THE CITY COUNCIL FROM ADDRESSING ANY ISSUE NOT PREVIOUSLY INCLUDED ON THE AGENDA.  THE CITY COUNCIL MAY RECEIVE COMMENT AND SET THE MATTER FOR A SUBSEQUENT MEETING.  SPEAKERS ARE ASKED TO LIMIT THEIR COMMENTS TO THREE MINUTES.  ALL REQUESTS TO SPEAK MUST BE RECEIVED PRIOR TO THE AGENDA ITEM BEING ADDRESSED.

CONSENT CALENDAR ITEMS

6.                   MINUTES -  JUNE 15, 2009 SPECIAL MEETING 7:00 PM

Recommended Action: Approve minutes as presented.

7.                   RATIFICATION OF ACCOUNTS PAYABLE EXPENDITURES

Recommended Action: Approve and ratify expenses as audited for checks 40603 to 40909 and wires 124, 125, 126, 127, 128, 129.

8.                   FINAL ACCEPTANCE OF BARSTOW: RE-ROOF AL VIGIL SWIM CENTER IN BARSTOW, 850 BARSTOW RD, BARSTOW, CA. 92311 - PROJECT NO. 2008-06

Recommended Action: That the City Council approve change order number 2 for $3032.00, approve final acceptance of the Barstow: Re-roof Al Vigil Swim Center Project (Project No. 2008-06), transfer $2,910.03 from the un-programmed fund for the project and that a Notice of Completion be filed and recorded with the San Bernardino County Recorder's Office.

9.                   CALIFORNIA DEPARTMENT OF TRANSPORTATION RACE-CONSCIOUS DBE PROGRAM

Recommended Action: Approve the DBE Implementation Agreement Exhibit 9-A and authorize the City Manager to sign the Agreement on behalf of the City of Barstow.

BUSINESS/ACTION ITEMS

10.               DESIGNATION OF VOTING DELEGATES FOR THE LEAGUE OF CITIES ANNUAL CONFERENCE TO BE HELD SEPTEMBER 16-18, 2009 IN SAN JOSE, CA

Recommended Action: By simple motion, designate a voting delegate and alternate as representatives for the Cty of Bartsow for the 2009 Annual League of Cities Conference to be held September 16-18, 2009 in San Jose, CA.

11.               FINANCE OF REPLACEMENT VEHICLES - RESOLUTION

Recommended Action: 1. Authorize the purchase of these vehicles from Downtown Ford. 2. Adopt a resolution approving a financing agreement with SunTrust Corporation in the amount of $158,669.88, payable over a 3 year period at an interest rate of 4.95%  3. Increase estimated revenue and appropriate loan proceeds in the amount of $145,611 4. Authorize City Manager Richard Rowe to execute lease documents on behalf of the City of Barstow.

12.               CONSIDERATION FOR EXTENDING THE EXEMPTION FOR DEVELOPMENT IMPACT FEES (DIF) ASSOCIATED WITH POTENTIAL BUILDING PERMITS MEETING THE GRANDFATHERING REQUIREMENTS DISCUSSED IN BMC 12.40.030 B, FOR AN ADDITIONAL YEAR (UNTIL AUGUST 1, 2010)

Recommended Action: Council should discuss the issue associated with grandfathering DIF's. If there is interest in extending the DIF exemption until August 1, 2010, staff should be directed to amend the Ordinance to extend the DIF exemption until August 1, 2010, for the building permits for homes that would qualify.

13.               ADOPTION OF THE ETHICS CODE FOR THE CITY OF BARSTOW

Recommended Action: Approve the attached Code of Ethics for the City of Barstow.

14.               APPROVAL TO PARTICIPATE IN THE SAN BERNARDINO COUNTY COMMUNITY DEVELOPMENT & HOUSING'S SENIOR HOME REPAIR PROGRAM FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDING

Recommended Action: Approve participation in the Senior Home Repair Program with San Bernardino County Community Development & Housing Department for three (3) years with an annual contribution of $47,223 by San Bernardino County.
