PUBLIC HEARINGS

PUBLIC COMMENTS: THIS IS THE TIME AND PLACE FOR THE GENERAL PUBLIC TO ADDRESS THE CITY COUNCIL ON MATTERS WITHIN THEIR JURISDICTION THAT ARE NOT CURRENTLY ON THE AGENDA.  STATE LAW PROHIBITS THE CITY COUNCIL FROM ADDRESSING ANY ISSUE NOT PREVIOUSLY INCLUDED ON THE AGENDA.  THE CITY COUNCIL MAY RECEIVE COMMENT AND SET THE MATTER FOR A SUBSEQUENT MEETING.  SPEAKERS ARE ASKED TO LIMIT THEIR COMMENTS TO THREE MINUTES.  ALL REQUESTS TO SPEAK MUST BE RECEIVED PRIOR TO THE AGENDA ITEM BEING ADDRESSED.

CONSENT CALENDAR ITEMS

4.                   SECOND READING - ORDINANCE NO. 849-2009 ADOPTING A COMPREHENSIVE AMENDMENT TO SECOND UNIT (ACCESSORY DWELLING UNITS) REGULATIONS CONTAINED IN THE BARSTOW MUNICIPAL CODE (REF.: PORA-09-0001)

Recommended Action: That the City Council adopt Ordinance No. 849-2009, comprehensively amending the City's Accessory Dwelling Units regulation, read by title only and waive the full reading.

5.                   RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW DECLARING ITS INTENTION TO SET THE TIME, DATE AND PLACE FOR A PROTEST HEARING FOR DELINQUENT ADMINISTRATIVE FINES AND PENALTIES FOR AUGUST 3, 2009 AT 7:30 PM

Recommended Action: Approve the Resolution No. ______-2009, setting a date and time for a protest hearing for delinquent Administrative Code Fines and Penalties for Monday, August 3, 2009 at 7:30 p.m. in the Council Chambers and to waive the full reading.

6.                   REQUEST PROTEST HEARING DATE FOR DELINQUENT UTILITY ACCOUNTS

Recommended Action: Set the protest hearing for delinquent utility accounts for Monday, August 3, 2009 at 7:30 p.m. in the Council Chambers.

7.                   RATIFICATION OF ACCOUNTS PAYABLE EXPENDITURES

Recommended Action: Approve and ratify expenses as audited for check 40910-41055.

8.                   REQUEST FOR STREET CLOSURE - MAIN STREET USA RUN

Recommended Action: The City Council:  1) Adopt Resolution No. _____-2009, making the Statement of Findings authorizing the street closure and waive the full reading, and  2) Authorize expenditure of the estimated costs.

BUSINESS/ACTION ITEMS

9.                   AUTHORIZATION OF PAYMENT TO URS, THE CONSULTANT FOR THE DESIGN OF THE LENWOOD GRADE SEPARATION, AND SUPPLEMENTAL APPROPRIATION OF FUNDS

Recommended Action: Staff recommends that the City Council increase estimated revenue and approve a supplemental appropriation in the amount of $423,900 for the design portion of the contract with URS as described above.

10.               LANDSCAPING AND STREET MAINTENANCE ASSESSMENT DISTRICT #1, STREET LIGHTING AND FLOOD CONTROL ASSESSMENT DISTRICT #1

Recommended Action: The City Council approve Resolution No. _____-2009 to initiate proceedings to levy and collect annual assessments and ordering the City Engineer to prepare an Engineer's Report for Landscaping Assessment District #1, Street Maintenance Assessment District #1, Street Lighting Assessment District #1, and Flood Control Assessment District #1, and waive the full reading.

11.               ANNUAL RENEWAL OF LANDSCAPING, STREET MAINTENANCE, STREET LIGHTING AND FLOOD CONTROL MAINTENANCE DISTRICT #1

Recommended Action: That the Council approve and adopt Resolution No. _____-2009, approving the Engineer's Report, and Resolution No. _____-2009, declaring the City's intention to levy and collect annual assessments in Fiscal Year 2009-10 in connection with Landscape Maintenance District No. 1, Street Maintenance District No. 1, and Flood Control Maintenance District No. 1, and setting a public hearing for August 3, 2009.

12.               CONTINUATION OF CONSIDERATION FOR EXTENDING THE EXEMPTION FOR DEVELOPMENT IMPACT FEES (DIF) ASSOCIATED WITH POTENTIAL BUILDING PERMITS MEETING THE GRANDFATHERING REQUIREMENTS DISCUSSED IN BMC 12.40 (ATTACHED), FOR AN ADDITIONAL YEAR (UNTIL AUGUST 1, 2010), AND CONSIDERATION FOR ADJUSTING THE TIMING OF COLLECTING DIF'S

Recommended Action: Council should again discuss the issues associated with grandfathering DIF's in light of new information presented. If there is interest in extending the DIF exemption until August 1, 2010, staff should be directed to amend the Ordinance to extend the DIF exemption until August 1, 2010, for the building permits for homes that would qualify.

13.               COUNCIL CONSIDERATION OF AN ORDINANCE THAT WOULD CHANGE THE DATE FOR THE IMPOSITION AND PAYMENT OF ALL DEVELOPMENT IMPACT FEES, FROM THE ISSUANCE OF A BUILDING PERMIT TO THE FINAL BUILDING INSPECTION

Recommended Action: Council approve the preparation of an ordinance that would change the date for the imposition and payment of all development impact fees, from the issuance of a building permit to the final building inspection.

14.               WASTEWATER RECLAMATION FACILITY PHASE 1A IMPROVEMENTS PROJECT & CEASE AND DESIST ORDER COMPLIANCE UPDATE PRESENTATION

Recommended Action: None.
